DOT Attorney Applauds Handling of Troha Taxes, Reveals Ties to Troha

The Wisconsin Department of Transportation's Chief Counsel has determined the DOT's handling of a tax dispute with indicted Kenosha businessman Dennis Troha involved nothing untoward, and was carried out "impeccably."

Chief Counsel Robert Jambois said he has reported his assessment of the handling of the dispute over taxes due on truck miles with Troha-linked firms to Governor Doyle.

The FBI is investigating the DOT's handling of the matter, which included Doyle cabinet member, DOT Secretary Frank Busalacchi intervening personally with Troha and ordering out of state trips to try to settle the tax debt with two other states.

At a news conference at DOT's Hill Farms headquarters in Madison, Jambois also said his family has financial ties to Troha as a result of his wife Beverly's paid work in promoting a proposed Kenosha casino in a 2004 referendum vote.

"My wife worked as a coordinator for that project, for the pro-casino forces, and that was largely financed by Dennis Troha."

Troha pulled out of the proposed $800 million project just before a federal grand jury indicted him for allegedly funneling illegal campaign contributions to Doyle. Doyle's approval would be needed for any casino to be built. Troha's attorney has said Troha did nothing illegal.

Kenosha County Clerk records show Beverly Jambois and the couple's daughter, Stacey were paid a total of $6,506 for work for Jobs For Kenosha.

Jambois is former Kenosha County District Attorney.

Jambois said his objectivity was unaffected by his family's financial ties to Troha as he reviewed the DOT's work on the tax dispute over truck miles driven in five other states by Troha-tied firms. "I was completely satisfied the Department behaved in a completely appropriate fashion."

DOT officials said, and state documents show, after several years of disputing owed taxes, Troha company attorney William Jennaro requested a meeting with Busalacchi. Jennaro had previously worked for the Doyle administration as as state counsel in negotiations on Indian gaming compacts. Documents show a April, 2004 meeting was scheduled between Busalacchi, Troha and others, but Jambois said Busalacchi has no recollection of Troha actually attending the meeting. After the meeting, Busalacchi directed DOT officials to travel to Pennsylvania and Illinois to try to settle the trucking firms' tax debt with those states. Wisconsin is part of a compact of states called IFTA (International Fuel Tax Agreement), which requires a trucking firm's home state to collect motor fuel taxes and distribute them to appropriate states
